Welcome to Modern Reef USA. These Terms & Conditions (“Terms”) govern your access to and use of our website, online store, content, and services (collectively, the “Site”), as well as purchases of products from Modern Reef USA LLC.

  • May not be suitable for your specific aquarium system, livestock mix, or conditions.
  • Should always be used with your own judgment, testing, and caution.

3.3 No Guarantee of Results
Aquarium systems differ widely (water chemistry, equipment, livestock, feeding, maintenance). Therefore:

  • We do not guarantee any specific results, coral growth, coloration, stability, or outcomes.
  • Results may vary greatly from tank to tank, even when using the same products and methods.

4. Proper Use of Products – Important Safety Notice

Unless clearly stated otherwise:

  • All products are for aquarium use only.
  • Not for human consumption.
  • Not for use on or in animals, livestock, or pets directly (beyond normal aquarium usage as directed).
  • Keep out of reach of children and pets.

4.2 Follow Instructions Carefully
You must:

  • Read and follow all product labels, instructions, and safety warnings.
  • Use a reliable test kit and regularly monitor water parameters.
  • Start with lower doses when appropriate and adjust gradually.
  • Avoid mixing products or methods that are incompatible with each other or with your specific system.

4.3 Your Responsibility for Tank & Livestock
You are solely responsible for:

  • Evaluating the suitability of our products for your system.
  • Understanding the needs and sensitivities of your livestock and corals.
  • Monitoring your aquarium and making conservative, informed decisions.

Misuse, overdosing, incorrect application, poor maintenance, incompatible livestock, underlying system issues, or failure to follow instructions can cause:

  • Water chemistry imbalance
  • Tank crashes
  • Coral stress or death
  • Fish or invertebrate losses

To the fullest extent permitted by law, we are not responsible for any damage, loss of livestock, or harm to your aquarium system arising from:

  • Product misuse or overuse
  • Failure to follow instructions
  • Use inconsistent with common reef-keeping practices
  • Use together with third-party products, equipment, or methods
  • Pre-existing issues or instabilities in your tank

5. Orders, Pricing & Payment

5.1 Product Availability
All products and prices are subject to availability and may be changed or discontinued at any time without notice. We may limit quantities.

5.2 Order Acceptance
Your order is an offer to buy. Acknowledgment of your order (e.g., by email) does not mean we accept it. We accept your order only when we ship the product and send a shipping confirmation.

We may refuse or cancel any order at our discretion, including for reasons such as:

  • Product unavailability or inventory errors
  • Errors in product information, pricing, or payment
  • Suspected fraud or abuse
  • Violations of these Terms

If we cancel an order after charging your payment method, we will issue a refund for the applicable amount.

5.3 Pricing & Taxes
Prices are shown in U.S. dollars (USD) unless otherwise stated. We use reasonable efforts to ensure accurate prices, but errors may occur.

  • If a product is listed at an incorrect price, we may cancel or refuse the order, even after confirmation, and will refund any amount paid.

5.4 Payment
We accept the payment methods listed at checkout. You authorize us and our payment processors to charge your selected payment method for the full order amount, including taxes and shipping.

You represent that you are authorized to use the payment method you select.

6. Shipping, Delivery & Risk of Loss

6.2 Risk of Loss
Unless otherwise required by law:

  • Risk of loss or damage to products passes to you when we deliver the products to the carrier.
  • Once the carrier accepts your package, any delays, loss, or damage are between you and the carrier, subject to our Shipping Policy and the carrier’s terms.

Delivery timelines are estimates only and are not guaranteed. We are not liable for delays caused by:

  • Carriers, customs, or postal services
  • Weather, natural disasters, or other events beyond our reasonable control

By submitting User Content, you grant Modern Reef USA a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sub-licensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media, for any lawful purpose, including marketing.

We may, but are not obligated to, monitor, edit, or remove User Content at our discretion.

11. Prohibited Uses

12.2 Aquarium & Livestock Disclaimer

Without limiting the generality of the above:

  • We do not guarantee that our products or methods are safe or effective for every aquarium system, every combination of livestock, or every user.
  • We do not guarantee against coral loss, fish or invertebrate deaths, algae outbreaks, or any other negative outcome in your aquarium.
  • You understand that reef-keeping involves inherent risks and variability.

You use our products and follow our methods entirely at your own risk.

13. Limitation of Liability

To the fullest extent permitted by applicable law:

13.1 Exclusion of Certain Damages
Modern Reef USA LLC, its owners, directors, employees, contractors, and affiliates will not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, goodwill, data, or business opportunities
  • Loss of livestock (fish, corals, invertebrates), plants, or other organisms
  • Damage to aquariums, equipment, or property
  • Costs of replacement livestock, corals, or systems

arising out of or in connection with your use of the Site, products, or content, even if we have been advised of the possibility of such damages.

13.2 Maximum Liability
In no event will our total liability to you for any and all claims relating to your use of the Site, products, or these Terms exceed the amount you actually paid to us for the product or service giving rise to the claim.

13.3 Application
The foregoing limitations apply to all causes of action, whether based in contract, tort (including negligence), strict liability, or any other legal theory.

Some states do not allow certain limitations or exclusions of liability, so some of the above may not apply to you. In such states, our liability will be limited to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless Modern Reef USA LLC and its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

  • Your use of our products in a manner inconsistent with our instructions or common reef-keeping practices

18.2 Jurisdiction & Venue

These Terms, together with our Privacy Policy, Refund & Return Policy, Shipping Policy, and any additional terms that apply to specific products or services, constitute the entire agreement between you and Modern Reef USA LLC regarding your use of the Site and purchase of products.
